The Product may only be used for the applications as provided on www.tikitag.com or any other application developed by or for ALU Bell NV. For any avoidance of doubt, ALU Bell NV declares that the Product is not protected by the “TIKITAG” trademark (registration procedure pending). The “TIKITAG” trademark protects all software applications and services as provided on www.tikitag.com or any other application developed by or for ALU Bell NV. ALU Bell NV hereby warrants to the original costumer only that the Product will be free in normal use of any defects in materials and workmanship for a period of two (2) years from the costumer’s original date of purchase directly from ALU Bell NV or its fulfillment house. At its sole option, ALU Bell NV will repair or replace the defective Product and promptly return it to you. In order for this warranty to be valid, the costumer must, at the time the Product is returned, provide proof of purchase in the form of the original purchase receipt directly from ALU Bell NV or its fulfillment house. If ALU Bell NV elects to replace the defective product, then ALU Bell NV reserves the right to replace the defective product with another product of the same model or a model of at least comparable quality and features in ALU Bell NV’s sole determination. This warranty is not transferable. This warranty does not apply in cases of abuse or misuse of the Product, use contrary to ALU Bell NV’s instruction, use for other applications than as provided on www.tikitag.com or any other application developed by or for ALU Bell NV, ordinary wear and tear, an act of God, negligent use, purchase from a party other than authorized by ALU Bell NV, unauthorized repair, or modification of the Product. ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE HEREBY DISCLAIMED TO THE EXTENT PERMITTED UNDER APPLICABLE LAWS. This warranty does not restrict the rights of the consumer mandated under applicable laws. THIS WARRANTY SUPERSEDES ALL OTHER WARRANTIES THAT ARE ASSOCIATED OR INCLUDED WITH THESE PRODUCTS. BY THIS AGREEMENT. ALU BELL NV DOES NOT PROVIDE ANY WARRANTY FOR THE USE OF THE TIKITAG TRADEMARK. ALL WARRANTIES, SUCH AS BUT NOT LIMITED TO NON-INFRINGEMENT OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS ARE HEREBY EXPLICITLY DISCLAIMED BY ALU BELL NV FOR THE TIKITAG TRADEMARK. ALU BELL NV DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN. ALU BELL NV WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, SUCH AS LOST PROFITS, LOSS OF BUSINESS OR FOR LOST OR CORRUPTED DATA OR SOFTWARE EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, ALU BELL NV IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, THE REMEDIES SET FORTH IN THIS AGREEMENT SHALL APPLY EVEN IF SUCH REMEDIES FAIL THEIR ESSENTIAL PURPOSE. The parties agree that this Agreement, any sales there under, or any claim, dispute or controversy between customer and ALU Bell NV arising from or relating to this agreement shall be governed by the laws Belgium.
